These Terms of Service ("Terms") govern your access to and use of the Tuxon platform, website, and related services (collectively, the "Service"), operated by Tuxon ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Use of the Service

You must be at least 18 years old and provide accurate information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may use the Service only for lawful purposes and in accordance with these Terms.

2. Your content and conduct

You retain ownership of the content you upload (such as customer data, knowledge-base content, and message templates). You are solely responsible for it. You agree not to use the Service to:

Send unsolicited messages (spam) or contact anyone without proper consent;
Violate any applicable law, regulation, or the rules of third-party platforms (including telecommunications and messaging providers);
Upload unlawful, infringing, or harmful content; or
Attempt to gain unauthorized access to the Service or its systems.

3. Messaging and consent

If you use the Service to send SMS, email, or other messages, you are responsible for obtaining all required consents from recipients and for honoring opt-out requests. You agree to comply with all applicable anti-spam and privacy laws (including the U.S. CAN-SPAM Act, TCPA, and equivalent local regulations) and with the messaging policies of our underlying providers.

4. Fees and billing

Certain features are paid. Fees are described in the Service and are charged in advance or as usage occurs (such as per-message costs). You authorize us to charge the payment method on file. Fees are non-refundable except as required by law.

5. Intellectual property

The Service, including its software, design, and branding, is owned by Tuxon and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service for your business. You may not copy, resell, or reverse-engineer the Service.

6. Availability and termination

We may modify, suspend, or discontinue the Service (in whole or in part) at any time. We may suspend or terminate your account for violations of these Terms. You may stop using the Service and close your account at any time.

7. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Tuxon is not liable for indirect, incidental, special, or consequential damages, or for any loss of data, revenue, or goodwill, arising from your use of the Service. Our total liability is limited to the amounts you paid us in the three (3) months preceding the claim.

8. Changes to these Terms

We may update these Terms from time to time. We will post any changes on this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
